Terms of Service

About these terms

These terms apply to all services provided by MM Digital, based in Durban, KwaZulu-Natal, South Africa, including web design, web development, SEO, graphic design, online marketing, hosting, content writing, and IT support. By accepting a quote or instructing us to begin work, you agree to these terms.

Quotes and pricing

All quotes are provided in South African Rand and are valid for 30 days unless stated otherwise. A quote is based on the information and requirements provided at the time. If the scope of a project changes after work has started, we will discuss any additional cost with you before proceeding.

Payment terms

For most projects, a deposit is required before work begins, with the balance due on completion or as agreed in the quote. For ongoing services such as hosting, maintenance, SEO, and marketing, fees are billed monthly in advance. Late payment may result in work being paused until outstanding amounts are settled.

Project process and timelines

Timelines provided in a quote are estimates based on a normal working schedule and timely feedback from the client. Delays in providing content, feedback, or approvals may extend the project timeline accordingly. We will keep you informed of progress and any changes to the original timeline.

Revisions

Most projects include an agreed number of revision rounds, set out in the quote. Additional revisions beyond this may be billed separately at our standard rate.

Ownership and intellectual property

Once a project is paid in full, ownership of the final website files, designs, and content created specifically for you transfers to you, the client. This does not include third-party assets such as licensed stock photography, fonts, plugins, or themes, which remain subject to their own licence terms. MM Digital retains the right to display completed work in our portfolio unless otherwise agreed in writing.

Hosting and domains

Where MM Digital provides hosting or domain registration, these are billed separately on a recurring basis. If a hosting or domain account is registered in MM Digital's name on your behalf, we will provide access details and assist with transferring it to your own account if requested.

Client responsibilities

You agree to:

• Provide content, images, logins, and approvals in a timely manner so the project can proceed on schedule
• Ensure that any content, images, or materials you provide do not infringe on the rights of any third party
• Keep login details for your website and hosting accounts secure

Warranties and liability

We aim to deliver work to a high standard and will correct any genuine defects in our work at no extra cost within a reasonable period after handover. MM Digital is not liable for losses arising from third-party services (such as hosting providers, payment gateways, or platforms like Google and Meta), changes to those services, or content and decisions made by the client.

Maintenance and support

Websites require ongoing maintenance to remain secure and functional. Where a maintenance package is not in place, MM Digital is not responsible for issues arising from software updates, security vulnerabilities, or third-party plugin changes that occur after handover.

Termination

Either party may end an ongoing service arrangement, such as hosting, maintenance, SEO, or marketing, by giving 30 days' written notice. For project-based work, if a client cancels a project partway through, payment is due for work completed up to that point.

Governing law

These terms are governed by the laws of South Africa. Any disputes arising from these terms will be subject to the jurisdiction of the South African courts.

Changes to these terms

We may update these terms from time to time. The version in effect at the time a quote is accepted will apply to that project.
